1. About these terms
By browsing this website, purchasing a product or using a service offered through The Great Indian Library, you agree to these Terms & Conditions. If you purchase a sound library, the Sound Library Licensing Agreement also applies. If a product page or purchase receipt contains specific terms, those specific terms apply to that product if they conflict with these general terms.
2. Website use
You may use the website for lawful personal and business purposes connected with discovering, evaluating and licensing sound recordings. You must not interfere with the website, attempt unauthorized access, distribute malware, scrape the service in a way that harms its operation, misrepresent your identity or use the website to infringe another person’s rights.
3. Products and product information
We aim to describe every library, file count, format, resolution, location, contributor and preview accurately. Minor corrections may be made when metadata or product information is incomplete or incorrect. Preview audio is compressed and may not represent the full fidelity of delivered files. Artwork and website presentation are illustrative; the product consists of the downloadable files and documentation described on the product page or checkout receipt.
4. Orders, pricing and payment
Purchases are completed through Gumroad or another checkout provider identified on the product page. The checkout provider displays the final price, currency, tax and payment methods before you pay. Its payment and account terms also apply. An order is accepted when payment is confirmed and download access is issued. We may cancel and refund an order affected by an obvious pricing error, fraud, legal restriction or inability to supply the product.
5. Digital delivery
Libraries are delivered digitally using the email address or account supplied at checkout. You are responsible for providing accurate contact details, keeping download links secure and maintaining your own backups after download. If a valid link expires or delivery fails, contact us with proof of purchase and we will make reasonable efforts to restore access.
6. Licenses
A purchase grants only the usage rights in the Sound Library Licensing Agreement. Unless the checkout explicitly says otherwise, the purchase is a single-user license. Multi-user, enterprise, educational and custom licenses require written confirmation.
7. Refunds and consumer rights
Because digital audio cannot be physically returned, completed downloads are generally non-returnable and sales are final, except where a refund is required by applicable consumer law, the checkout provider’s mandatory policy or a written product guarantee. If you believe files are corrupt, materially incomplete or different from the product description, contact us promptly with your order information so we can repair, replace or otherwise resolve the issue.
Nothing in these terms limits rights that cannot be excluded under applicable consumer law.
8. Intellectual property
The website, branding, text, catalog data, artwork and original recordings are owned by The Great Indian Library, the credited contributors or their licensors. You may not copy or commercially exploit website content except as permitted by law or with written permission. Rights in purchased Sounds are governed exclusively by the Licensing Agreement.
9. Third-party services and links
The website may link to Gumroad, SoundCloud, mapping providers and other third-party services. Those services are operated independently and have their own terms and privacy practices. We are not responsible for their availability, content or acts, but this does not affect any responsibility we have for products we sell.
10. Availability and changes
We may update, suspend or discontinue website features, product availability, previews and prices. Changes do not reduce rights already granted under a completed purchase. We do not guarantee uninterrupted access to the website or third-party checkout and streaming services.
11. Disclaimers and liability
Except for promises expressly stated in these terms and rights that cannot legally be excluded, the website is provided “as is” and “as available”. To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss caused by use of the website or a third-party service. Our total liability for a purchased product will not exceed the amount paid for that product. Nothing excludes liability that cannot lawfully be limited.
12. Privacy and submissions
Do not send confidential or sensitive information through any prototype or interest form unless the page clearly states that submissions are being transmitted and explains how they will be used. The current contributor-interest prototype saves its note only in the visitor’s browser and does not send it to us. Email sent to our contact address is handled for support and business communication.
13. Governing law
These terms are governed by the laws of India. Disputes are subject to the courts of competent jurisdiction in the place where the relevant seller is established, unless mandatory consumer law requires otherwise. If any provision is unenforceable, the remaining provisions continue in effect.
14. Updates and contact
We may revise these terms by posting an updated version and date. The terms in force when an order is accepted continue to govern that purchase unless a change is required by law or benefits the purchaser.
